Another law (SB 726) quickly followed the 2014 US Farm Bill, which legalized commercial hemp production. After the 2018 Farm Bill, Virginia pushed through two more laws (HB 532 and SB 247) to bring their laws in line with federal laws.
At the same time, Virginia also passed two more laws (SB 726 and HB 1252) to broaden the existing medical cannabis program in the state. In 2021, the VA house and senate both passed a bill to legalize recreational marijuana, which is set to come into effect in 2024.
After the 2018 US Farm Bill (Agricultural Improvement Act) made it legal to cultivate industrial hemp, at the same time, they defined hemp as any cannabis plant which contained less than 0.3% tetrahydrocannabinol (THC).
Therefore, despite it being legal at a federal level to grow and produce hemp goods (including CBD products), it’s up to individual states to introduce a legal framework around the production and cultivation of hemp products.
What Is CBD?
Cannabidiol (CBD) is one of over one hundred different cannabinoids found in hemp and marijuana plants. Both CBD and tetrahydrocannabinol (THC) are considered major cannabinoids, but unlike THC, CBD has no psychotropic properties.
Almost all CBD products made in the USA and available throughout Virginia are made using CBD sourced from industrial hemp plants because they are high in CBD and low in THC.
