CBD & Cannabis Laws in Virginia

Are CBD and cannabis legal in Virginia? Everything you need to know about buying CBD and cannabis in Virginia!

What is the current legal status of CBD in Virginia, and what should you know before you buy any CBD products in Virginia?

In the following article, we’re going to take a closer look at the current Virginia CBD and cannabis laws and what you need to know before buying any CBD in Virginia.

What are the Virginia CBD Laws?

CBD oil in Virginia is 100% legal and available to buy both in stores and online. Virginia has robust and healthy cannabis and hemp industry that has been in operation for over a decade, and CBD is legal to purchase as long as it contains less than 0.3% THC.

The Virginia Department of Agriculture and Consumer Services (VDACS) is responsible for administering licenses to those interested in cultivating hemp throughout Virginia.

According to state and federal regulations, CBD products are 100% legal as long as they contain less than 0.3% THC, in line with the US 2018 Farm Bill.

Interestingly, recently Virginia lawmakers voted to amend their cannabis laws to introduce minimum legal possession amounts of cannabis (up to 1 ounce for adults) while also making it legal to grow up to four cannabis plants per household.

Although recreational marijuana won’t be available until 2024, the new laws were put in place to help offset the disproportionate amounts of low-income and minorities being charged with offenses related to cannabis possession.

Always purchase CBD products from companies that offer quality guarantees and provide independent third-party laboratory testing of their CBD oils and products.

When purchasing any CBD, check out the labels and the product description for clearly displayed amounts of the active ingredient (cannabidiol). Also, look for companies that stand behind their CBD products with transparent return policies.

Stirling CBD stocks a wide selection of premium CBD products, all of which are available online in Virginia and include fast delivery options.

One of CBD’s biggest benefits is its versatility. There are various delivery methods, including CBD oils, CBD tinctures, CBD creams and balms, CBD edibles, and Delta 8 vape products.

While initial studies and anecdotal evidence about CBD look extremely promising, we still have a lot to learn about cannabidiol. More clinical trials are required before we can make any specific medical claims.

As with anything, no two people or their conditions are the same, and what helps one person may not work for another.

Virginia CBD Laws – Is CBD Legal?

For decades now, Virginia has been pro CBD with the legal framework to grow and cultivate hemp products well in place before the 2018 US Farm Bill came into effect. In this section, we’ll take a brief look at the timeline of hemp laws in the state of Virginia.

Three laws passed between 1997 and 2001 (HJ 656, HJ 94, HJ 605) set the stage for Virginia’s legal hemp production. These laws allowed farmers to experiment with industrial hemp to evaluate its potential economic impact on Virginia.

Another law (SB 726) quickly followed the 2014 US Farm Bill, which legalized commercial hemp production. After the 2018 Farm Bill, Virginia pushed through two more laws (HB 532 and SB 247) to bring their laws in line with federal laws.

At the same time, Virginia also passed two more laws (SB 726 and HB 1252) to broaden the existing medical cannabis program in the state. In 2021, the VA house and senate both passed a bill to legalize recreational marijuana, which is set to come into effect in 2024.

After the 2018 US Farm Bill (Agricultural Improvement Act) made it legal to cultivate industrial hemp, at the same time, they defined hemp as any cannabis plant which contained less than 0.3% tetrahydrocannabinol (THC).

Therefore, despite it being legal at a federal level to grow and produce hemp goods (including CBD products), it’s up to individual states to introduce a legal framework around the production and cultivation of hemp products.

What Is CBD?

Cannabidiol (CBD) is one of over one hundred different cannabinoids found in hemp and marijuana plants. Both CBD and tetrahydrocannabinol (THC) are considered major cannabinoids, but unlike THC, CBD has no psychotropic properties.

Almost all CBD products made in the USA and available throughout Virginia are made using CBD sourced from industrial hemp plants because they are high in CBD and low in THC.

There is a lot of anecdotal evidence from people worldwide who have used CBD for its natural swelling and redness reducing properties, backed up by several medical studies. However, more clinical trials are required before we can make any specific medical claims.

CBD is non-psychotropic, which means that it isn’t going to give you that ‘euphoric high’ like THC products would. CBD products throughout Virginia are legal if they contain less than 0.3% THC.

What Could Make CBD Products Illegal in Virginia?

Currently, any CBD products which contain more than 0.3% THC could be considered illegal in Virginia unless you are enrolled in the state’s medical-marijuana program.

If CBD products are produced from marijuana plants high in THC, the overall amount of THC in the finished product could be higher than the allowed 0.3%.

The 1970 Federal Controlled Substances Act categorized all types of cannabis, which includes hemp, as Schedule I narcotics.

The 2014 US Farm Bill changed when they recognized a significant difference between marijuana and hemp. They defined any cannabis plant with less than 0.3% THC as hemp and above 0.3% THC as marijuana.
